Welcome to The Foto Pod! By booking our services, you agree to the following terms and conditions. Please read them carefully before proceeding with your booking.

1. General

1.1. The following terms and conditions govern the use of services provided by The Foto Pod, a company registered in Melbourne, Australia.
1.2. By booking our services, you acknowledge that you have read, understood, and agree to these terms and conditions.
1.3. The Foto Pod reserves the right to amend or update these terms at any time without prior notice.
1.4. It is your responsibility to review the terms regularly. Continued use of our services constitutes acceptance of any changes.

2. Booking and Payment

2.1. All bookings are subject to availability and are only confirmed once a deposit has been received.
2.2. A non-refundable deposit of AUD $150.00 is required to secure your date and time.
2.3. The remaining balance is due 3 days prior to the event date. Failure to pay the remaining balance may result in cancellation of the booking.
2.4. Payments can be made via credit card, apple pay or paypal.

3. Cancellation and Rescheduling

3.1. In the event of cancellation by the client, the deposit will not be refunded.
3.2. If a cancellation is needed due to unforeseen circumstances within reason and with adequate evidence, please contact and we will happily assist you with a refund.
3.3. Requests to reschedule your booking must be made at least 7 days prior to the event, and are subject to availability.
3.4. The Foto Pod reserves the right to cancel a booking in the case of unforeseen circumstances such as equipment failure, sickness, or any other unavoidable incident. In such cases, a full refund or rescheduled booking will be offered.

4. Service Duration and Set-Up

4.1. Standard hire periods are for 3-5 hours depending on the chosen package or unless otherwise agreed upon. Additional hours can be arranged for an extra fee, subject to availability.
4.2. The Foto Pod team will arrive approximately 45 minutes prior to the event start time for set-up and ensure the photo booth is ready for use.
4.3. The client is responsible for ensuring there is adequate space and power supply at the venue for the photo booth. A minimum space of 3 meters x 3 meters and access to a power outlet is required.
4.4. If set-up is delayed due to the venue or client, no extension of service time will be provided unless additional payment is arranged.

5. Use of the Photo Booth

5.1. The photo booth is for the enjoyment of all guests. However, misuse, vandalism, or any behaviour that may damage the equipment will result in immediate termination of service.
5.2. The client agrees to be responsible for any damage caused to the photo booth or equipment by their guests during the event. Repair or replacement costs may be invoiced to the client.

6. Prints and Digital Copies

6.1. Unlimited prints are available during the event for all guests, within the hire period.
6.2. Digital copies of all photos taken will be provided to the client as a digital album (accessible via a link) after the event within the stated time period as denoted in the chosen package inclusions.
6.3. The Foto Pod is not responsible for any loss of digital files after they have been provided to the client.

7. Copyright and Usage

7.1. The Foto Pod retains the copyright of all images taken during the event.
7.2. We reserve the right to use images for promotional purposes, including but not limited to social media, our website, and marketing materials. If you do not wish for your event’s photos to be used for such purposes, please notify us in writing prior to the event.
7.3. Guests may use the images for personal, non-commercial use. Any commercial use of the images requires prior written consent from The Foto Pod.

8. Liability

8.1. The Foto Pod is not liable for any loss or damage to personal property during the event.
8.2. In the unlikely event of equipment failure, delays, or inability to provide services due to circumstances beyond our control, The Foto Pod's liability is limited to the amount paid for the booking.
8.3. The Foto Pod is not responsible for the quality of photos affected by external factors such as lighting or venue conditions.

9. Health and Safety

9.1. The Foto Pod takes health and safety seriously and will take all reasonable precautions to ensure the safety of guests and staff.
9.2. The client is responsible for ensuring the event venue complies with health and safety regulations.
9.3. The Foto Pod reserves the right to refuse service in situations where health and safety may be compromised.

10. Governing Law

10.1. These terms and conditions are governed by the laws of the state of Victoria, Australia.
10.2. Any disputes arising from these terms and conditions shall be subject to the jurisdiction of the courts of Victoria.
